TERMS AND CONDITIONS OF USE

These Terms and Conditions of Use ("Terms") govern the access to and use of the website www.rupixtra.com, any mobile application, digital platform, software, APIs, portals, dashboards, communication interfaces and all allied services (collectively, the "Platform") owned and operated by Shreshtha Creditguru Fintech Private Limited, the parent company of "RupiXtra" a company incorporated under the Companies Act, 2013, having its registered office at PT-C-315, Aditya World City, Shahpur Bamheta, Ghaziabad, Uttar Pradesh – 201002 (hereinafter referred to as "SCFPL", "Company", "we", "our" or "us").
These Terms constitute a legally binding agreement between SCFPL and every individual, customer, borrower, visitor or entity accessing or using the Platform ("User", "you" or "your").
By registering on, accessing or using the Platform, you acknowledge that you have read, understood and agreed to be bound by these Terms, the Privacy Policy, the Key Fact Statement (where applicable), and any additional agreements executed with the relevant Lending Partner.
If you do not agree with these Terms, you must immediately discontinue use of the Platform.
These Terms are governed by:
- the Information Technology Act, 2000;
- the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (to the extent applicable);
- the Digital Personal Data Protection Act, 2023;
- the Reserve Bank of India's Digital Lending Guidelines, as amended from time to time;
- the Master Directions, circulars, notifications and other regulatory instructions issued by the Reserve Bank of India ("RBI"); and
- all other applicable laws in force in India.
1. DEFINITIONS
Unless the context otherwise requires, the following terms shall have the meanings assigned below:
"Applicable Law" means all statutes, rules, regulations, circulars, notifications, directions, guidelines, judicial decisions and governmental orders applicable to SCFPL, the Platform or the Services.
"Account" means the User account created on the Platform.
"Authorised Service Provider" means any third-party service provider engaged by SCFPL for KYC verification, identity authentication, cloud hosting, analytics, payment processing, fraud prevention, customer support or other ancillary services.
"Business Day" means any day on which banks are open for business in India.
"Credit Information Company" or "CIC" means any company registered under the Credit Information Companies (Regulation) Act, 2005 including TransUnion CIBIL Limited, Experian Credit Information Company of India Private Limited, Equifax Credit Information Services Private Limited and CRIF High Mark Credit Information Services Private Limited.
"Digital Lending Guidelines" means the guidelines, circulars and directions issued by the Reserve Bank of India relating to digital lending, as amended from time to time.
"Key Fact Statement" or "KFS" means the standardized disclosure document provided by the relevant Lending Partner prior to execution of a loan agreement containing the Annual Percentage Rate (APR), interest, fees, repayment schedule, cooling-off period, grievance mechanism and other mandatory disclosures prescribed by RBI.
"Lending Partner" means any RBI-regulated Bank, Non-Banking Financial Company (NBFC) or other regulated entity that offers financial products through the Platform.
"Lending Service Provider" or "LSP" means an agent or service provider engaged by a regulated entity for providing digital lending services in accordance with RBI guidelines.
"Personal Data" shall have the meaning assigned under the Digital Personal Data Protection Act, 2023.
"Platform" means the website, mobile applications, APIs, software systems and digital interfaces owned or operated by SCFPL.
"Services" means digital lending facilitation, loan sourcing, financial technology services, identity verification, credit assessment assistance, payment facilitation, customer support and allied services made available through the Platform.
"User" means any individual or entity accessing or using the Platform.
2. SCOPE OF SERVICES
SCFPL is a technology-enabled financial services company providing digital infrastructure to facilitate interactions between Users and regulated financial institutions.
The Platform enables Users to/access:
- financial advisory;
- risk mitigation;
- treasury management;
- submit loan applications digitally;
- compare lending products;
- complete KYC and identity verification;
- upload supporting documents;
- obtain credit eligibility assessments;
- receive loan offers from Lending Partners;
- execute loan documentation electronically;
- monitor application status;
- access repayment information;
- avail other technology-enabled financial services offered from time to time.
SCFPL is not:
- a bank;
- a Non-Banking Financial Company (NBFC);
- a deposit-taking institution;
- a money lender;
- a financial guarantor; or
- the lender of record.
SCFPL merely acts as a technology platform and, where applicable, as a Lending Service Provider (LSP) for regulated entities. As a mere facilitator, SCFPL is not responsible for any processing delays on account of the LSP or on account of the User for genuineness of any submitted document.
3. ROLE OF SCFPL AS LENDING SERVICE PROVIDER
SCFPL performs technology and support services on behalf of regulated Lending Partners.
These services may include:
- customer onboarding;
- identity verification;
- KYC facilitation;
- collection of loan applications;
- document management;
- preliminary eligibility assessment;
- API integrations;
- customer communication;
- repayment reminders;
- customer support; and
- other services permitted under RBI regulations.
SCFPL does not independently sanction loans.
SCFPL or its representatives do not take any form of payment from the User.
SCFPL does not determine:
- loan approval;
- interest rates;
- tenure;
- credit limits;
- repayment obligations;
- foreclosure terms; or
- recovery actions.
These decisions remain solely with the relevant Lending Partner.
4. DISCLOSURE OF LENDING PARTNERS
SCFPL shall maintain and publish on its Platform an updated list of all Lending Partners with whom it has entered into valid commercial arrangements.
Such disclosure shall include, where applicable:
- name of the Lending Partner;
- registered office;
- RBI registration details (where applicable);
- customer care details;
- grievance contact details;
- role performed by SCFPL;
- nature of services rendered by SCFPL as LSP.
SCFPL does not guarantee that every User will receive offers from every Lending Partner.
Loan offers depend upon:
- internal credit policies;
- eligibility;
- regulatory requirements;
- underwriting criteria;
- fraud checks;
- portfolio risk; and
- commercial decisions of the Lending Partner.
5. ELIGIBILITY
5.1 The Platform and the Services are available only to individuals and entities who are legally competent to enter into binding contracts under the Indian Contract Act, 1872.
5.2 By using the Platform, you represent and warrant that:
(a) you are at least eighteen (18) years of age;
(b) you are an Indian citizen or a person legally entitled to avail financial services in India;
(c) the information provided by you is complete, accurate and up to date;
(d) you are not impersonating any other individual or entity;
(e) you are not debarred by any regulatory authority, court or governmental agency from availing financial services;
(f) you possess all necessary legal authority to enter into these Terms.
5.3 Where the User is a company, LLP, partnership firm or other legal entity, the individual accepting these Terms represents that he/she has been duly authorised to bind such entity.
5.4 SCFPL reserves the right to refuse registration or access if the eligibility requirements are not satisfied.
6. USER REGISTRATION AND ACCOUNT
6.1 Registration
To access certain Services, Users must register on the Platform and create an Account.
Registration may require submission of:
- Full Name
- Mobile Number
- Email Address
- PAN
- Aadhaar (where legally permissible)
- Date of Birth
- Employment Details
- Income Information
- Address
- Bank Account Details
- Selfie Photograph
- Video KYC details (where applicable)
- GST or business information (for business applicants)
- Any additional information required by the Lending Partner or applicable law.
6.2 Accuracy of Information
You undertake that every document, declaration and statement submitted through the Platform is true, complete and not misleading.
You shall promptly update any change in your information.
SCFPL may suspend processing where discrepancies are identified.
6.3 Account Security
You shall maintain the confidentiality of:
- OTPs;
- passwords;
- login credentials;
- PINs;
- authentication devices.
You shall immediately notify SCFPL upon becoming aware of:
- unauthorised access;
- identity theft;
- compromise of credentials;
- suspicious activity.
Unless attributable to SCFPL's negligence or wilful misconduct, you shall remain responsible for all activities undertaken through your Account.
6.4 Suspension of Account
SCFPL may suspend or disable an Account where:
- fraudulent activity is suspected;
- inaccurate information is provided;
- regulatory requirements so require;
- KYC verification fails;
- misuse of the Platform is detected;
- disparagement or defamatory act(s) on social media platform(s);
- the User breaches these Terms.
7. KNOW YOUR CUSTOMER (KYC) AND ANTI-MONEY LAUNDERING (AML) COMPLIANCE
7.1 SCFPL facilitates Know Your Customer ("KYC") verification in accordance with applicable laws and the requirements of the relevant Lending Partner.
7.2 Users expressly authorise SCFPL and its authorised service providers to verify identity using electronic KYC, video KYC, CKYC, DigiLocker, Aadhaar-based authentication (where legally permissible), PAN verification (where legally permissible) or any other legally recognised verification mechanism.
7.3 SCFPL may require Users to submit additional documents where required for:
- fraud prevention;
- anti-money laundering;
- sanctions screening;
- politically exposed person (PEP) verification;
- regulatory compliance.
7.4 Failure to complete KYC satisfactorily may result in rejection of the application.
8. USER REPRESENTATIONS AND WARRANTIES
You represent, warrant and undertake that:
(a) all information submitted is genuine;
(b) you shall use the Platform only for lawful purposes;
(c) you shall not manipulate credit information;
(d) you shall not upload forged documents;
(e) you shall not misuse the Platform to commit fraud;
(f) you shall not attempt to gain unauthorised access to the Platform;
(g) you shall not misrepresent to any third-party your access to the Platform;
(h) you shall comply with all applicable laws.
You acknowledge that any false declaration may expose you to civil and criminal liability.
9. CONSENT AND AUTHORISATIONS
By clicking "I Agree", "Accept", "Proceed", providing an OTP, using electronic signatures or otherwise using the Platform, you expressly authorise SCFPL to:
- collect your personal information;
- verify your identity;
- perform KYC;
- obtain credit bureau reports;
- share information with Lending Partners;
- share information with authorised service providers;
- communicate with you through SMS, WhatsApp, email, phone calls, push notifications and other digital channels;
- retain records for regulatory compliance;
- process your information for fraud detection and risk management.
You understand that withdrawal of consent may affect SCFPL's ability to provide Services.
10. CREDIT BUREAU AUTHORISATION
You expressly authorise SCFPL and the relevant Lending Partner to obtain, access, review and periodically refresh your credit information from one or more Credit Information Companies, including but not limited to:
- TransUnion CIBIL Limited;
- Experian Credit Information Company of India Private Limited;
- Equifax Credit Information Services Private Limited;
- CRIF High Mark Credit Information Services Private Limited.
You further authorise SCFPL to share your information with such entities as may be necessary for:
- credit assessment;
- fraud prevention;
- underwriting;
- portfolio monitoring;
- regulatory reporting.
Repeated bureau enquiries may occur during the processing of your application and, where applicable, during the tenure of your relationship with the Lending Partner.
11. LOAN APPLICATION PROCESS
11.1 Submission of an application through the Platform does not create any obligation upon the Lending Partner to sanction a loan.
11.2 Each application is independently evaluated by the relevant Lending Partner in accordance with its internal underwriting policies.
11.3 The Lending Partner may:
- approve;
- reject;
- seek additional documents;
- revise loan terms;
- withdraw an offer prior to execution.
11.4 SCFPL has no authority to influence or guarantee:
- loan approval;
- loan amount;
- interest rate;
- repayment schedule;
- disbursement timeline.
11.5 Loan disbursement, if approved, shall be made directly by the Lending Partner into the bank account designated by the User.
12. KEY FACT STATEMENT (KFS)
Prior to execution of any loan agreement, the relevant Lending Partner shall provide the User with a Key Fact Statement ("KFS") in accordance with applicable RBI directions.
The KFS shall, at a minimum, disclose:
- sanctioned loan amount;
- Annual Percentage Rate (APR);
- rate of interest;
- tenure;
- EMI amount;
- repayment schedule;
- processing fee;
- platform fee, if applicable;
- insurance premium, if any;
- statutory charges;
- penal charges;
- foreclosure charges, if any;
- cooling-off/right-to-exit period;
- grievance redressal mechanism;
- customer care details;
- name of the Lending Partner;
- name and role of SCFPL as Lending Service Provider.
The User is advised to carefully review the KFS before accepting the loan. SCFPL shall not be responsible for the acts of the User or the Lending Partner.
No charge shall be levied by SCFPL on the User.
13. RBI MANDATED COOLING-OFF / RIGHT TO EXIT
13.1 Where prescribed by applicable RBI guidelines or the Lending Partner's policy, the User shall be entitled to a cooling-off/right-to-exit period after loan disbursement.
13.2 During the cooling-off period, the User may exit the loan by repaying:
(a) the principal amount disbursed;
(b) the proportionate Annual Percentage Rate (APR) accrued up to the date of repayment; and
(c) such other charges as may be expressly permitted under applicable RBI guidelines and disclosed in the Key Fact Statement.
13.3 No undisclosed penalty or foreclosure charge shall be imposed during the cooling-off period.
13.4 The applicable cooling-off period shall be specified in the Key Fact Statement and the Loan Agreement issued by the relevant Lending Partner.
13.5 Requests for exercising the right to exit shall be made through the Platform or directly with the relevant Lending Partner in accordance with the procedure communicated in the Key Fact Statement.
14. FEES, CHARGES AND PAYMENTS
14.1 Disclosure of Charges
All fees, charges, costs and expenses payable in relation to any loan or Service shall be transparently disclosed before the User accepts the relevant loan offer or Service.
The applicable Lending Partner shall disclose such charges in the Key Fact Statement ("KFS"), Loan Agreement or other legally required documents, as per Lending Partner policy.
14.2 Platform Charges
SCFPL, as of the date of this policy, does not charge any fee to a loan applicant or user under descriptions like technology platform fees, convenience fees, verification charges, documentation charges, subscription charges for value-added services, other fees expressly communicated to the User or any other description.
No hidden charges shall be imposed.
14.3 Lending Partner Charges
Interest rates, processing fees, penal charges, foreclosure charges and other lending-related charges shall be determined solely by the relevant Lending Partner.
SCFPL does not determine or control such charges.
14.4 Taxes
All applicable taxes, duties, cess and levies shall be borne by the User unless otherwise specified under Applicable Law.
14.5 Refunds
Unless expressly stated otherwise, fees paid for technology-enabled Services are non-refundable once the relevant Service has been rendered.
Refunds, if applicable, shall be processed in accordance with the applicable policy or contractual terms.
15. USER OBLIGATIONS
The User agrees to:
(a) provide accurate, complete and current information;
(b) promptly update any change in personal, employment or financial details;
(c) maintain confidentiality of login credentials and OTPs;
(d) use the Platform only for lawful purposes;
(e) cooperate with KYC, fraud prevention and regulatory verification requirements;
(f) promptly respond to requests for additional documentation;
(g) ensure that all documents uploaded belong to the User or are uploaded with lawful authority;
(h) comply with all Applicable Laws.
The User shall not:
- impersonate another individual;
- use forged or altered documents;
- submit fraudulent applications;
- interfere with Platform security;
- introduce malware or malicious code;
- misuse APIs or software interfaces;
- scrape, harvest or extract Platform data without written consent;
- infringe intellectual property rights;
- use the Platform for misrepresentation, money laundering, terrorist financing or other unlawful purposes.
16. ACCEPTABLE USE POLICY
Users shall not:
- access another person's Account without authority;
- attempt to bypass Platform security measures;
- reverse engineer, decompile or disassemble the Platform;
- disrupt servers or networks;
- defame or disparage the Platform;
- upload viruses, ransomware or malicious software;
- create automated bots or scripts to access the Platform;
- engage in abusive, defamatory, obscene or unlawful conduct through the Platform.
SCFPL reserves the right to suspend or permanently block Users engaging in prohibited activities.
17. FAIR PRACTICES CODE
SCFPL is committed to ensuring that all activities undertaken in connection with digital lending are conducted fairly, transparently and responsibly.
Accordingly:
(a) Users shall receive clear disclosures regarding applicable charges and terms;
(b) Users shall receive the Key Fact Statement prior to loan acceptance;
(c) No misleading advertisements or representations shall be made;
(d) Customer complaints shall be addressed through an effective grievance redressal mechanism;
(e) SCFPL shall cooperate with Lending Partners in ensuring compliance with RBI's Fair Practices Code and Digital Lending Guidelines.
Nothing in these Terms shall prejudice any statutory rights available to Users under Applicable Law.
18. RECOVERY PRACTICES
Recovery of outstanding dues shall be undertaken solely by the relevant Lending Partner or its duly authorised recovery agents in accordance with Applicable Law and applicable RBI directions. SCFPL shall not be responsible for any such practices by the Lending Partner.
19. ELECTRONIC COMMUNICATIONS
The User consents to receive communications through:
- SMS;
- email;
- WhatsApp;
- in-app notifications;
- telephone calls;
- electronic records;
- digital signatures;
- other electronic communication channels permitted under Applicable Law.
Electronic communications shall constitute valid legal communication.
The User is responsible for ensuring that registered contact details remain current.
20. ELECTRONIC RECORDS AND ELECTRONIC SIGNATURES
The User agrees that:
- electronic records shall be legally valid under the Information Technology Act, 2000;
- OTP-based acceptance, electronic signatures and digital authentication mechanisms constitute legally binding acceptance;
- electronic copies of agreements shall have the same legal effect as physical documents.
Records maintained electronically by SCFPL shall, unless proven otherwise, constitute evidence of transactions conducted through the Platform.
21. PRIVACY, DATA PROTECTION AND CONFIDENTIALITY
SCFPL respects the privacy of its Users and processes Personal Data in accordance with:
- the Digital Personal Data Protection Act, 2023;
- the Information Technology Act, 2000;
- applicable RBI directions; and
- the Company's Privacy Policy.
By using the Platform, the User consents to the collection, processing, limited storage and sharing of Personal Data for purposes including:
- identity verification;
- KYC compliance;
- fraud prevention;
- credit assessment;
- customer support;
- regulatory compliance;
- analytics;
- service improvement.
The Company does not store any Personal Data beyond the consented use by the User or as required by law. All Personal data is forwarded as received by the User, to the Lending Partners or LSP, as the case may be. Users are encouraged to review the Privacy Policy, which forms an integral part of these Terms.
22. DATA LOCALISATION AND CROSS-BORDER TRANSFERS
SCFPL shall take reasonable steps to ensure that personal and financial data collected through the Platform is primarily processed within India in accordance with Applicable Law and regulatory requirements.
Where cross-border processing is undertaken through authorised service providers, SCFPL shall ensure that:
- appropriate contractual safeguards are implemented;
- confidentiality obligations are maintained;
- the transfer complies with the Digital Personal Data Protection Act, 2023 and any applicable governmental restrictions.
Users acknowledge that limited cross-border processing may occur for cloud infrastructure, cybersecurity, fraud monitoring or other ancillary technology services, subject to Applicable Law.
23. INTELLECTUAL PROPERTY RIGHTS
All rights, title and interest in and to the Platform, including:
- software;
- source code;
- object code;
- databases;
- algorithms;
- trademarks;
- logos;
- trade names;
- graphics;
- content;
- documentation;
- interfaces;
- designs;
- copyrights;
- patents;
- trade secrets; and
- other proprietary material,
shall remain the exclusive property of SCFPL or its licensors.
Nothing contained in these Terms shall confer any ownership rights upon the User.
Users shall not reproduce, modify, distribute, create derivative works from, publicly display or commercially exploit any part of the Platform without prior written consent.
24. DISCLAIMERS
The Platform and Services are provided on an "as is" and "as available" basis.
SCFPL does not warrant that:
- the Platform will operate uninterrupted;
- the Platform will be error-free;
- loan approval is guaranteed;
- any Lending Partner will sanction a loan;
- any particular interest rate or tenure will be offered;
- the Platform will be free from temporary outages.
SCFPL shall not be responsible for decisions taken independently by Lending Partners, including:
- rejection of loan applications;
- modification of loan terms;
- cancellation of sanctioned loans prior to disbursement;
- recovery proceedings lawfully initiated by Lending Partners;
- reporting of repayment history to Credit Information Companies.
25. LIMITATION OF LIABILITY
25.1 To the maximum extent permitted under Applicable Law, SCFPL acts solely as a technology platform and, where applicable, as a Lending Service Provider ("LSP") facilitating interactions between Users and RBI-regulated Lending Partners. SCFPL shall not be liable for any decision made independently by a Lending Partner.
25.2 SCFPL shall not be responsible for:
(a) rejection of any loan application or consequences thereof;
(b) modification of loan terms by the Lending Partner;
(c) delay in loan sanction or disbursement caused by the Lending Partner or any third party;
(d) suspension or discontinuance of Services owing to maintenance, technical failures or events beyond its reasonable control;
(e) unauthorised access resulting from the User's negligence, including compromise of passwords, OTPs or authentication credentials;
(f) indirect, incidental, special, punitive or consequential damages, including loss of profits, goodwill, business opportunity or anticipated savings.
25.3 Except where liability cannot be excluded under Applicable Law, SCFPL's aggregate liability arising out of or relating to the Platform or the Services shall not exceed the amount of fees, if any, actually received by SCFPL from the User in connection with the relevant transaction during the preceding twelve (12) months.
26. INDEMNITY
The User agrees to indemnify, defend and hold harmless SCFPL, its directors, officers, employees, affiliates, agents, contractors, licensors and service providers from and against any losses, liabilities, claims, actions, penalties, costs, damages or expenses (including reasonable legal fees) arising out of or relating to:
- breach of these Terms;
- submission of false, misleading or fraudulent information;
- misuse of the Platform;
- violation of Applicable Law;
- infringement of any intellectual property or third-party rights;
- negligence, wilful misconduct or fraudulent acts of the User.
27. SUSPENSION AND TERMINATION
27.1 SCFPL may suspend, restrict or terminate access to the Platform immediately, with or without prior notice, where:
- the User breaches these Terms;
- fraudulent activity is suspected;
- KYC requirements are not fulfilled;
- regulatory directions require suspension;
- defamation or disparagement of the Platform is done by the User;
- continued access may expose SCFPL, Lending Partners or other Users to legal or security risks.
27.2 Upon termination:
(a) access to the Platform may cease immediately;
(b) obligations relating to confidentiality, indemnity, intellectual property, dispute resolution and accrued liabilities shall survive termination;
(c) loan obligations shall continue to be governed by the respective Loan Agreement entered into with the relevant Lending Partner.
28. FORCE MAJEURE
SCFPL shall not be liable for any delay or failure in performance caused by events beyond its reasonable control, including but not limited to:
- acts of God;
- flood;
- fire;
- earthquake;
- epidemic or pandemic;
- war;
- terrorism;
- civil unrest;
- labour disputes;
- governmental actions;
- internet failures;
- power outages;
- cyber-attacks despite reasonable safeguards;
- failure of telecommunications infrastructure;
- acts or omissions of third-party service providers.
Performance shall resume as soon as reasonably practicable after the Force Majeure event ceases.
29. ASSIGNMENT
SCFPL may assign, novate or transfer its rights or obligations under these Terms to any affiliate, successor, acquirer or permitted assignee, subject to Applicable Law.
The User shall not assign or transfer any rights or obligations under these Terms without SCFPL's prior written consent.
30. WAIVER
Failure or delay by SCFPL in exercising any right or remedy shall not constitute a waiver of such right or remedy.
Any waiver shall be effective only if made in writing and signed by an authorised representative of SCFPL.
31. SEVERABILITY
If any provision of these Terms is held invalid, illegal or unenforceable by a court or competent authority, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
The invalid provision shall, where possible, be replaced with a valid provision that most closely reflects the original commercial intent.
32. AMENDMENTS
SCFPL reserves the right to amend, modify or update these Terms from time to time in order to:
- comply with Applicable Law;
- implement regulatory requirements;
- improve Services;
- introduce new products or features.
Updated Terms shall be published on the Platform together with the revised "Last Updated" date.
Continued use of the Platform after such publication shall constitute acceptance of the revised Terms.
33. NOTICES
Any notice required under these Terms shall be deemed duly given if sent through:
- registered email address;
- SMS;
- in-app notification;
- registered post;
- courier;
- publication on the Platform.
Users shall ensure that their contact details remain accurate and updated at all times.
34. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of India.
Nothing contained herein shall restrict any statutory rights available to consumers under Applicable Law.
35. DISPUTE RESOLUTION
35.1 The Parties shall endeavour to resolve disputes amicably through good-faith discussions within thirty (30) days.
35.2 If the dispute remains unresolved, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended.
35.3 The arbitration shall be conducted by a sole arbitrator mutually appointed by the Parties. Failing agreement, the arbitrator shall be appointed in accordance with the Act.
35.4 The seat and venue of arbitration shall be New Delhi, India.
35.5 The arbitration proceedings shall be conducted in the English language.
35.6 Subject to the arbitration clause, the courts having jurisdiction over the registered office of SCFPL shall have exclusive jurisdiction for matters not capable of arbitration.
36. GRIEVANCE REDRESSAL
SCFPL has established an effective grievance redressal mechanism in accordance with applicable RBI guidelines and the Digital Personal Data Protection Act, 2023.
Users may submit complaints regarding:
- Platform functionality;
- loan application processing;
- privacy concerns;
- customer service;
- data protection;
- unauthorised transactions;
- recovery-related concerns;
- any other issue relating to the Services.

SCFPL shall endeavour to acknowledge complaints within 48 hours, excluding holidays and non working days, and resolve them within the timelines prescribed under Applicable Law or RBI guidelines.
37. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, Key Fact Statement, Loan Agreement (where applicable), consent forms and any other documents expressly incorporated by reference, constitute the entire agreement between the User and SCFPL concerning the use of the Platform.
SCHEDULE A – REGULATORY DISCLOSURES
- SCFPL is a technology platform/Lending Service Provider and does not itself lend or accept deposits.
- Loan sanction, pricing, disbursement, servicing and recovery remain the responsibility of the respective RBI-regulated Lending Partner.
- Users will receive a Key Fact Statement before execution of the loan.
- Users shall be entitled to the RBI-mandated cooling-off/right-to-exit period, where applicable.
- SCFPL complies with the Digital Personal Data Protection Act, 2023, the Information Technology Act, 2000, and applicable RBI Digital Lending Guidelines.
